Presenta el resultado de un amplio ejercicio de cartograf\u00eda realizado en 24 Estados miembros de la UE, as\u00ed como en Islandia y Noruega, centrado en la relaci\u00f3n entre la migraci\u00f3n y la cobertura de la seguridad social de diferentes categor\u00edas de trabajadores nacionales de terceros pa\u00edses de corta duraci\u00f3n (por ejemplo, trabajadores desplazados, traslados dentro de una misma empresa, trabajadores temporeros, trabajadores cedidos por empresas de trabajo temporal, profesionales de alto nivel y trabajadores aut\u00f3nomos).<\/p>\n\n\n\n<p>Aunque, en principio, todos los trabajadores de la UE est\u00e1n y deben estar cubiertos por la seguridad social, determinados grupos de trabajadores est\u00e1n sujetos a incertidumbres y lagunas en la cobertura. Los nacionales de terceros pa\u00edses que trabajan en la UE por poco tiempo se encuentran entre los trabajadores a menudo sujetos a exclusiones de la cobertura de la seguridad social o no cubiertos para determinados riesgos. Los informes de los distintos pa\u00edses muestran que, por regla general, los empresarios que contratan a trabajadores migrantes nacionales de terceros pa\u00edses por periodos breves deben pagar las cotizaciones a la seguridad social y la asistencia sanitaria como lo hacen con los trabajadores locales contratados regularmente. En las distintas jurisdicciones, esta norma general est\u00e1 sujeta a diversas excepciones y restricciones. La fragmentaci\u00f3n interna y externa subrayada por la variedad de fuentes jur\u00eddicas que abordan las cuestiones de seguridad social, as\u00ed como la diversidad de enfoques, plantea potencialmente dificultades para la navegaci\u00f3n por los respectivos sistemas. Y aunque esto parece justificado a la luz de la discrecionalidad de los Estados miembros en materia de inmigraci\u00f3n y legislaci\u00f3n laboral, deber\u00eda aspirarse a una mayor seguridad jur\u00eddica para proteger mejor a los trabajadores que sufren esta fragmentaci\u00f3n y falta de cobertura.<\/p>\n\n\n\n<p><strong><a rel=\"noreferrer noopener\" href=\"https:\/\/etui.org\/sites\/default\/files\/2023-05\/Report%20on%20the%20social%20security%20rights%20of%20short-term%20third-country%20national%20migrant%20workers_2023.pdf\" target=\"_blank\">Informe publicado y  disponible<\/a> <\/strong>en la web del <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/etui.org\/publications\/report-social-security-rights-short-term-third-country-national-migrant-workers\" target=\"_blank\">EUROPEAN TRADE UNION INSTITUTE <\/a><\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>ABSTRACT:<\/strong> <\/p>\n\n\n\n<p>This report provides an overview of the ways in which EU and EEA Member States have regulated their social security frameworks in relation to short-term third-country national (TCN) migrant workers. It presents the result of an extensive mapping exercise carried out in 24 EU Member States, as well as Iceland and Norway, focussing on the relationship between migration and the social security coverage of different categories of short-term third-country national workers (for example, posted workers, intra-corporate transfers, seasonal workers, temporary agency workers, high-level professionals and self-employed).<\/p>\n\n\n\n<p>While every worker in the EU, in principle, is and should be covered by social security, certain groups of workers are subject to uncertainties and gaps in coverage. Third-country nationals who work in the EU for a short time are among the workers often subject to exclusions from social security coverage or not covered for certain risks. The individual country reports show that, as a general rule, employers who employ short-term third-country national migrant workers are supposed to pay social security and health care contributions as they do for regularly hired local workers. In the various jurisdictions this general rule is subject to various exceptions and restrictions. The internal and external fragmentation underlined by the variety of legal sources addressing social security issues, as well as the diversity of approaches potentially raises difficulties for the navigation of the respective systems.
